AGREEMENT, WAIVER & RELEASE OF LIABILITY

Responsibilities

I, the undersigned, as a participant in a tour arranged by Pronatura A.C. Veracruz, understand that the trip involves certain risks and dangers that occur in travel in foreign countries and wilderness areas, and that accident or injury can happen in remote places and that prompt and timely medical treatment may not be possible, and that there exists the risk of tropical and other diseases, political instability, and forces of nature. Moreover, I am in good health and able to participate in the activities of the tour, except as those otherwise mentioned in my Health Form. In choosing to participate, I fully accept and assume all risks during the Pronatura A.C. Veracruz tour. These include, without limitation, physical injury, mental injury, emotional distress, trauma, sickness, illness, and death. All risks are known and appreciated by me.

Knowing these facts and in consideration of my participation in the tour, I for myself and anyone acting on my behalf, release, waive, discharge, covenant not to sue and agree to hold Pronatura A.C. Veracruz organizers, sponsors, officials, volunteers and their representatives; and the officers, directors, employees, representatives, agents, and successors of all of the above, harmless from any and all claims, demands and actions of any and every kind I have, may have or may hereafter accrue against the released parties directly or indirectly arising out of or relating in any respect to my attending or participating in the tour of Pronatura A.C. Veracruz.

Pronatura Veracruz and its staff act only as agents for the passenger and therefore assume no liability for injury, death, loss, accident, delay, damage, or irregularity which may be occasioned either by reason of defect in any vehicle or for any reason whatsoever, or through the acts or defaults of any company or person engaged in conveying the passenger or in carrying out the arrangements of the tour. Pronatura Veracruz will not be responsible for any losses or additional expenses or inconvenience due to delay or changes in airline or other services, nor for the loss of, or damage to, baggage or any other article belonging to the passenger.
